Cypriot club Anorthosis Famagusta disputed the interest rate applied to overdue payments owed to player Erik Sabo, arguing 15% per year was excessive.
CAS placed the rate on a spectrum it has developed through its own case law: above the 5% default rate that applies where a contract is silent, but comfortably below the roughly 18% per year the Swiss Federal Tribunal has previously indicated could still be acceptable in an appropriate case. On that basis, 15% was found to be proportionate rather than punitive.
The appeal was dismissed, and the club was ordered to pay the player CHF 4,000 — a useful, concrete data point for where a contractual interest rate sits on the range CAS actually regards as acceptable.
